*Pine & Spruce Win in Court.
Friends of Pine & Spruce (FOPS) is pleased to announce an important step forward in our fight to protect the quality of life and safety of our neighbors. Thanks to the work of our attorney, George Bochetto, the court issued an injunction prohibiting the City from enforcing neighborhood loading zones on Pine and Spruce Streets. This week, the City began removing the loading zone signs and restoring regular parking.
City Council may attempt to reinstate the zones through new legislation, FOPS will continue to actively participate in that debate. We are urging the City to work with residents on a balanced solution that addresses the needs of all stakeholders, particularly our elderly neighbors, disabled persons, and families with children. We have made clear to City Hall that we are ready and willing to discuss reasonable compromises.
Our legal case remains strong. We have:
Amended our Complaint to directly challenge the “No Stopping” ordinance.
Successfully defeated the City’s motion to dismiss the case.
Entered the discovery phase, where we will request documents and depose City officials in preparation for trial.
Begun exploring a second injunction against other elements of the program, including concrete barriers.
FOPS has spotlighted the real need for speed control across the City’s High Injury Network, while exposing the futility of spending millions on concrete barriers for Pine and Spruce. We’ve also gained the attention of ADA advocates, reinforcing the importance of protecting access for disabled residents.
This victory is not just about parking spaces, it’s about ensuring that our neighborhood remains safe, accessible, and livable for all.
